The following describes the terms on which Zooven offers you access to our services.

Introduction

Welcome to Zooven. By using the services available from the domain and sub-domains of www.zooven.com (the "Site") you are agreeing to the following terms, including those available by hyperlink (the "Agreement" or "User Agreement") with Zooven Inc. Before you may become a member of Zooven, you must read and accept all of the terms and conditions in, and linked to, this User Agreement. We strongly recommend that, as you read this User Agreement, you also access and read the linked information. By accepting this User Agreement, you also agree that your use of other Zooven branded web sites will be governed by the User Agreement and Privacy Policy posted on those web sites. This Agreement is effective on July 1st, 2006 for current users, and upon acceptance for new users.

Using Zooven

• post content or photos that are illegal or inappropriate on the Site;
• violate any laws, third party rights, or our policies;
• use the Site if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Site;
• manipulate the price of any item or interfere with other user's listings;
• circumvent or manipulate our fee structure, the billing process, or fees owed to Zooven;
• post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
• distribute or post spam, chain letters, or pyramid schemes on the Site or to other Zooven users;
• distribute viruses or any other technologies that may harm Zooven, or the interests or property of Zooven users;
• copy, modify, or distribute content from the Site and Zooven's copyrights and trademarks; or
• harvest or otherwise collect information about users, including email addresses, without the express written consent of Zooven, Inc.

Fees and Services

Joining Zooven and searching for real estate free. We do charge fees for using other services, such as listing properties. When you list a property or use a service that has a fee you have an opportunity to review and accept the fees that you will be charged based on our product prices, which we may change from time to time. Changes to that Policy are effective after we provide you with at least fourteen days' notice by posting the changes on the Site. We may choose to temporarily change the fees for our services for promotional events (for example, free listing days) or new services, and such changes are effective when we post the temporary promotional event or new service on the Site.

Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees and applicable taxes associated with the Site in a timely manner with a valid payment method.

Content License

When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. (These rights are necessary for us to host and display your content.)

Liability

You will not hold Zooven responsible for other users' actions or inactions, including things they post. You acknowledge that we are not a licensed broker. Instead, the Site is a venue to allow anyone to market their property, to people all over the world. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, condition or legality of properties advertised, the truth or accuracy of listings, the ability of owners to sell items or the ability of buyers to pay.

Release

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

No Agency

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Ad Format Items

Zooven Real Estate Advertisement format has the following features:

• You can list your asking price.
• Interested parties fill out a request a viewing form and their information is sent to you.
• You can advertise your property for 1 month (30 days), 6 months (180 days) or until it sells
• You may revise your listing, add, edit or remove photos at any time in the advertisement duration.
• The listing duration is for the amount of time you purchase starting on the date purchased. Additional time is not added for time periods where you mark your property inactive.

Real Estate Licensees

Advertisers who are licensed as an agent, broker, or other licensed real estate professional must ensure that their listing description conforms to all laws and regulations applicable to online advertising of properties by such licensees.

Professional Assistance

The purchase and sale of real estate is a complicated matter that is governed by laws, practices and customs that vary significantly from locality to locality. Sellers are advised that many jurisdictions require that you provide a disclosure statement to all prospective buyers regarding the condition of your property. In addition, under U.S. federal law, sellers have an obligation to disclose information on lead-based paint hazards. Members are strongly advised to seek the help of a licensed real estate professional and/or a real estate attorney to help in the negotiation and sale of any real estate.
